Welcome to lisaproshina.com. These Terms and Conditions (“Terms”) govern your use of coaching services provided by Elizaveta Proshina (“Coach”) and form the basis of our professional relationship. By booking or participating in a coaching session, you (“Client”) agree to these Terms.
1. Client Statement
I, the Client, agree to undertake the agreed session/s of 60 minutes each to address key changes I wish to make in my life. I am committed to taking positive action to make improvements in my life and to meeting the goals I identify as necessary to do this. I am committed to being as open and honest as necessary in order to work with my Coach towards achieving my goals.
1.1 Ground Rules
The Client:
- I understand that I am fully responsible for the decisions and choices reached during the coaching sessions.
- I understand that coaching is a relationship designed to facilitate the development of personal or professional goals and to create a plan/strategy for achieving those goals.
- I understand that coaching is a comprehensive process, which may involve all areas of my life including work, family, health, relationships, education, and recreation. I acknowledge that deciding how to handle any issues is my responsibility.
- I understand that coaching is not a substitute for counselling, mental health care, or substance abuse treatment.
- I promise to inform my Coach if I am currently in any kind of therapy and that any medical or therapeutic practitioners involved in my care have been advised of my intention to work with a coach.
- I agree to commit to the programme of coaching sessions to facilitate the required change.
- I understand that my Coach is a sounding board for me and will use deep listening skills and questions to support me in achieving clarity about my goals and how best to achieve them. My coach’s role is not to tell me what to do, think, or feel. Sessions are confidential and non-judgmental.
- Coaching sessions will take place either on the phone (WhatsApp) or by Zoom. Any other digital method of communication must be agreed upon in advance. It is my responsibility to contact the Coach via the agreed media at the agreed time of each session.
- The Coach will be available only during scheduled sessions. Any additional communication outside of sessions (e.g., email support) must be agreed upon in advance.
1.2 Timetabling of Sessions
The Client:
- If I need to re-arrange any appointments, I will give at least 48 hours’ notice. I understand that if I fail to give 48 hours’ notice, my Coach will be within their rights to charge for that session.
- If my Coach needs to re-arrange any appointments, they will give as much notice as possible and the new time will be agreed upon by both parties. There will be no extra cost to me for the rearranged session.
- Sessions included in a coaching package will be scheduled in consecutive weeks and, except with written agreement, no session will be more than two (2) weeks apart from the previous one.
- At each session, I will agree on the date and time of the following session with my coach.
2. Payment
All sessions are to be paid for in advance before the first session takes place.
Payment can be made by Bank Transfer (please contact us for the payment details) or by Debit/Credit Card.
Payments for coaching packages are non-refundable once sessions have begun. Any unused sessions may, at the discretion of the coach, be rescheduled within a maximum period of three (3) months from the original purchase date.
3. Confidentiality
All sessions are confidential, with the exception of circumstances where disclosure is required by law (such as imminent risk of harm to self or others, or court orders). While every effort will be made to maintain privacy when using digital platforms (e.g., Zoom, WhatsApp), the Client acknowledges that absolute security cannot be guaranteed.
4. Disclaimer of Guarantees
The Coach makes no guarantees about the results of the coaching process. The Client acknowledges that progress depends on their own effort, commitment, and follow-through.
5. Termination of Agreement
The Coach reserves the right to terminate this agreement if they believe coaching is no longer appropriate or productive. In such cases, unused sessions will be refunded proportionally.
6. Force Majeure
Neither party shall be liable for any failure or delay in performing obligations under this agreement due to circumstances beyond reasonable control, including but not limited to illness, technical outages, or unforeseen emergencies.
7. Non-Transferability
Coaching sessions are non-transferable and may not be assigned to another person without prior written consent from the coach.
8. Entire Agreement
This document represents the entire agreement between Coach and Client and supersedes any prior verbal or written understandings.
9. Indemnity
The Client agrees to indemnify and hold harmless the Coach from any and all claims, liabilities, damages, or expenses arising from the Client’s decisions, actions, or use of outcomes resulting from the coaching process. The Client acknowledges that the Coach does not provide advice, directives, or therapy, and that all choices and actions remain the sole responsibility of the Client.
10. Limitation of Liability
The coach’s total liability under this agreement, whether in contract, tort, or otherwise, shall not exceed the total fees paid by the Client for the coaching services, except in cases of willful misconduct or gross negligence by the coach. The Coach shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with the coaching relationship.
11. Severability
If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
12. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the Republic of Panama. Any disputes arising under this agreement will be subject to the exclusive jurisdiction of the courts of Panama.
